The Family and Medical Leave Act of 1993 (FMLA) provides covered employees with an entitlement to a total of up to 12 weeks of unpaid leave (LWOP) during any 12 month period for certain family and medical needs.

The CFRA provides job-protected medical leave for eligible employees with unpaid time off for their own serious health conditions; to care for a covered family member with a serious health condition; for bonding with a newborn child, a foster child or an adopted child; and for a qualifying military exigency.

The Family and Medical Leave Act (FMLA) provides certain employees with up to 12 weeks of unpaid, job-protected leave per year. It also requires that their group health benefits be maintained during the leave.

An employee is entitled to use sick leave when he or she: receives medical, dental, or optical examination or treatment; is incapacitated for the performance of duties by physical or mental illness, injury, pregnancy, or childbirth; or.

Applying for FMLA The employee's health care provider must complete a certification form that validates the employee's serious health condition or that of an immediate family member. The employee must provide this certification to the employer within 15 calendar days of receiving it.

Federal FMLA Rights. Eligible Florida employees may take up to 12 weeks of leave for serious health conditions, bonding with a new child, or preparation for a family member's military service; more leave is available for employees who need to care for a family member who was seriously injured on active military duty.
