1. A guardianship shall terminate on the minor's death, adoption, emancipation, or attainment of majority. 2.

Making decisions regarding the care, maintenance, health, education, welfare, and safety of the protected person except as otherwise limited by the court.

The new legislation requires the parent to show that the guardianship should be terminated if the parent did not consent to the original guardianship. If the parent does so, the guardian must show that the guardianship should not be terminated by clear and convincing evidence. Request a consultation with an attorney.

In Iowa, you have to file an action against the other party to seek enforcement of the existing court decree order. The enforcement action is formally known as an Application for Rule to Show Cause, commonly referred to as a contempt filing. This filing brings the opposing party's bad acts to the court's attention.

To end a minor guardianship before the child turns 18, you must file a motion to request the court to terminate the guardianship, and the court may hold a hearing on the motion. When a child turns age 18, the minor guardianship automatically ends with the filing of a final report. See Iowa Code section 232D.

Changing (or modifying) a guardianship or conservatorship is similar to setting one up. A petition for “modification” is filed with the court. A hearing date is set. Interested persons may present facts at the hearing.

You must file a petition for appointment of a guardian for a minor in the district court for the county where the minor is found or in the county where the minor lives. There is no official Iowa court form for a petition for minor guardianship at this time.
