The State of New Mexico requires pass-through entities (which may be a state law partnership or a limited liability company taxed as a partnership) to withhold tax at 5.9% on earnings of non-resident partners or members if the owner's distributive share of net income is over $100 in a year.

The tax rate of the entity level tax is equal to the higher of the maximum individual income tax rate imposed pursuant to section 7-2-7 NMSA 1978 or the maximum corporate income tax rate imposed pursuant to section 7-2A-5 NMSA 1978 for the taxable year, both currently 5.9%.

The state imposes a governmental gross receipts tax of 5.00% on the receipts of New Mexico state and local governments. The exceptions are the gross receipts of public school districts and entities licensed by the Department of Health that are principally engaged in providing health care.
