Follow the steps to accurately complete the form online.

  1. Press the ‘Get Form’ button to access the form and open it in the appropriate editor.
  2. Begin in Section 1, titled 'Employee Information and Verification'. Here, the employee must fill in their last name, first name, middle initial, and maiden name if applicable. Additionally, provide the address, including street name and number, city, state, zip code, and date of birth.
  3. In Section 1, input the Social Security number and check the appropriate box to indicate immigration status, whether the individual is a citizen, lawful permanent resident, or an alien authorized to work.
  4. The employee must then sign and date the form in Section 1 to attest that the information provided is accurate.

  6. Move to Section 2, where the employer will review and verify the documents provided. The employer will select either one document from List A or one from List B and one from List C as stated on the reverse side of the form.
  7. In Section 2, the employer must record the document title, issuing authority, document number, and expiration date, if applicable. The employer will then certify that the documents appear to be genuine.
  8. The employer's authorized representative must sign, print their name, provide the organization name, and enter the date.
  9. In Section 3, if applicable, the employer may update the form with a new name, date of rehire, and provide information for current employment eligibility if previous authorization has expired.
  10. Finally, complete the certification in Section 3, where the employer verifies that the employee is eligible to work and signs the form with the date.

Every time the government releases a new Form I-9, it sets an expiration date. This allows the government to make periodic updates to the form. We expect that U.S. Citizenship and Immigration Services (USCIS) will release a new version of the form before the expiration date on August 31.

E-Verify is an Internet-based system that allows businesses to determine the eligibility of their employees to work in the United States. E-Verify is fast, free and easy to use — and provides a way for employers to ensure a legal workforce.

The Social Security Administration (SSA) issues U.S. Social Security cards (although the U.S. Department of Health and Human Services issued older versions). SSA issues unrestricted Social Security cards to U.S. citizens and individuals lawfully admitted to the United States on a permanent basis.

Use Form I-9 to verify the identity and employment authorization of individuals hired for employment in the United States. All U.S. employers must properly complete Form I-9 for each individual they hire for employment in the United States.

Within 3 business days of starting work for pay, you must present to your employer documentation that establishes your identity and employment authorization. For example, if you begin employment on Monday, you must present documentation on or before Thursday of that week.

The Form I-9 was developed to facilitate compliance with Section 274A of the Immigration and Nationality Act, as amended by the Immigration Reform and Control Act of 1986, making employment of unauthorized aliens unlawful and diminishing the flow of illegal workers in the United States.

For 1-9 paperwork violations in 2022, the penalties range from $252 to $2,507 for the first offense for substantive violations or uncorrected technical errors. The range is $1,161 to $2,322 for second and subsequent paperwork offenses.

What should I do? A case cannot be created in E-Verify without an SSN. If a newly hired employee has applied for, but has not yet received his or her SSN (e.g., the employee is a newly arrived immigrant), attach an explanation to the employee's Form I-9 and set it aside.
