LMIA Fees and Additional Employer Requirements A processing fee of CDN $1,000 applies to each Labour Market Impact Assessment application (unless the application is made strictly in support of permanent residency).

To obtain an LMIA for permanent residency, an employer must have been in business for at least one year. Employers must meet the following criteria to be eligible for LMIA coverage for all other types of businesses: Has a legitimate business. Provides goods or services to the public.

Labour Market Impact Assessment (LMIA) gives an employer permission to hire a temporary foreign worker. It shows that there is a need for a foreign worker to fill the job and no Canadian worker is available to do the job. LMIA based work permit is a two-step application process.

In general, the period of validity of the LMIA to support a work permit application is 18 months. Note: In certain cases where an employer has specific timelines for a short employment opportunity, ESDC may issue LMIAs that expire in under 18 months.

Your LMIA application can be submitted up to 6 months prior to the expected job start date. There are 2 ways you can apply: online through the LMIA Online Portal, or. by emailing or faxing a PDF application form.

LMIA application fee is $1,000 per employee. The employer is responsible for the application fees and associated legal service costs. For example, if the employer is willing to hire 5 foreign employees, the employer would have to file 5 separate LMIA applications.

Your employer does not require an LMIA to transfer you to a position in Canada, but you will need to apply for an employer-specific work permit. If you're a U.S. citizen, you qualify for an intra-company transfer under the USMCA and can apply for a work permit at your Canadian port of entry.
