IRS Publication 510, Excise Taxes, has information on the proper method for reporting and paying the tax. Ordinarily, dyed diesel fuel is not taxed, because it is sold for uses exempt from excise tax, such as to farmers for farming purposes, for home heating use and to local governments for buses.

Red: Red-dyed diesel, or simply red diesel, is the most common type of dyed diesel. It contains a red dye that is so highly visible that it can be detected even when it does not alter the diesel's color. Red diesel can only be legally used in off-road vehicles and machinery, due to it's relatively high sulfur content.

Dyed diesel is tax exempt and may be used for limited purposes. Construction equipment, reefers, agricultural equipment, generators, and refrigerators can be powered by this diesel. You should not use dyed fuel for any unauthorized purpose, or you could be subject to extensive fines and back-taxes.

The state of Texas requires businesses/people who purchase dyed diesel to obtain a Dyed Diesel Fuel End User Number before any dyed-diesel can be purchased. If you don't know if your company has one, you can search for your company's dyed diesel number with the State of Texas Fuel License search.

Red diesel is chemically no different than any other fuel, so it can be used in your truck, as heating fuel, and in a generator. However, this product is reserved for agricultural and construction equipment and other off-road uses.

Red diesel is not for general sale or for use on public roads in the majority of cases. You will need to go to a specialist fuel supplier in order to purchase red diesel legally.

You must obtain an End User Number from the Comptroller's office. It is run by IRS. Whether it is Washington, Texas, Florida, Ohio, Alabama, or other states, the fine for illegal use of dyed diesel is $10/gallon or $1,000 per violation (a tank with red diesel), whichever is greater.
