The McKinney-Vento Homeless Assistance Act (McKinney-Vento Act) (42 United States Code § 11431-11435) is federal legislation that ensures the educational rights and protections of children and youth experiencing homelessness.

How does McKinney-Vento define homelessness? The McKinney-Vento Act defines homeless children as “individuals who lack a fixed, regular, and adequate nighttime residence.” This definition includes (but is not limited to) children who are: sharing housing due to economic hardship or loss of housing (e.g. doubled-up)

The McKinney-Vento Act requires school districts to ensure that “homeless children and youths are identified by school personnel and through coordination with other entities and agencies.” 42 U.S.C. §11432(g)(6)(A).
