A putative father is a man who might be a child's biological father, but is not the legal father. For example, if a man has sex with a woman who he is not married to, and that woman has a child, that man would be a putative father.

If the father is not listed on the birth certificate, his paternity can be challenged, so proving that he is the biological father will be necessary. An unmarried father, upon proving that he is the child's biological father, must also file a petition with the court to receive custody and visitation rights.

A putative father is a man whose legal relationship to a child has not been established, but claims to be the father or who is alleged to be the father of a child who is born to a woman to whom he is not married at the time of the child's birth. What is a Putative Father Registry?

Alleged fathers in Alabama have the right to be notified of adoption proceedings involving their children. Alabama Law allows a putative father – a man who assumes or alleges to be the father of a child – to be notified of adoption proceedings involving the child.

Section 63.054, Florida Statutes, provides for the establishment of a Putative Father Registry in the Bureau of Vital Statistics. The purpose of the registry is to permit a man alleging to be the unmarried biological father of a child to preserve his right to notice and consent in the event of an adoption.

Alabama Law (Code of Alabama 1975, Section 26-10C-1) says that a putative father – a man who thinks or says he is the father of a child born out of wedlock – should be notified if the child is being adopted by someone.

These states are Alabama, Arizona, Arkansas, Florida, Idaho, Indiana, Kansas, Kentucky, Louisiana, Maryland, Massachusetts, Michigan, Mississippi, New Hampshire, New Jersey, New Mexico, North Dakota, Oregon, Rhode Island, Texas, Virginia, and Washington.
