Binding arbitration is a process in which a neutral third party, called an arbitrator, is used to resolve disputes between two or more parties. The arbitrator will listen to both sides of the dispute, review any relevant evidence, and make a final and binding decision on the matter.

There are also some disadvantages of arbitration to consider: No Appeals: The arbitration decision is final. There is no formal appeals process available. Even if one party feels that the outcome was unfair, unjust, or biased, they cannot appeal it.

For binding arbitration, there are limited opportunities for appeal. That gives finality to the arbitration that is not often available with a trial decision, which maybe subject to appeals, new trials and further appeals.

Advantages of Binding Arbitration Typical binding arbitration to resolve a dispute is less costly in the long run than going to trial before a judge or jury because the process is quicker to resolve due to the congestion of our court system.

Because arbitration prevents your claims taken seriously, there's no upside to remaining in a mandatory arbitration agreement. Even if you opt out, you can still choose arbitration to settle a dispute, so there's no downside to opting out.

Binding arbitration means that the parties waive their right to a trial and agree to accept the arbitrator's decision as final. Generally, there is no right to appeal an arbitrator's decision. Non-binding arbitration means that the parties are free to request a trial if they do not accept the arbitrator's decision.
