Any person who is offered an Article 15, has the option of “turning it down” and demanding a trial by court-martial. This is a big decision for many reasons. First, while you may face punishment at an Article 15 if you are convicted, it does not constitute a criminal conviction.

The Burden of Proof in the Military The accused is presumed innocent until proven guilty by legal and competent evidence beyond a reasonable doubt. If there is reasonable doubt, it must be resolved in favor of the accused, and he or she must be acquitted.

Standard of Proof NJP authority must determine that a preponderance of the evidence shows the allegation to be true (i.e., more likely than not is true).
