The FDA does not require HACCP plans for all food groups. However, companies that fall under the Food Safety Modernization Act (FSMA) must now have a written FSP to satisfy the Human Food Rule. FSPs take a preventive controls approach to control hazards and encompass HACCP principles.

FSMA recognizes that FDA has previously established a preventive control type regulation for fish and fishery products (Title 21, Code of Federal Regulations (21 CFR) part 123, the seafood HACCP regulation) based on the Hazard Analysis and Critical Control Point (HACCP) concept.

The act, signed into law in 2011, seeks to protect public health more effectively by strengthening the food safety system. FSMA focuses on preventing food safety problems before they occur and recognizes the importance of strong foodborne illness and outbreak surveillance systems.

A FSMA food safety plan is essentially an extension of Hazard Analysis and Critical Control Points (HACCP) plans, but it includes additional regulations to address more comprehensive elements of food safety.

The Preventive Controls for Human Food Final Rule sets new standards that all food processors must meet with regards to facility registration, updated good manufacturing practices, employee qualifications and training, hazard analysis, risk-based preventive controls, food safety plans and related activities.

The Food and Drug Administration (FDA) and the United States Department of Agriculture (USDA) require mandatory HACCP programs for juice and meat as an effective approach to food safety and protecting public health. Meat HACCP systems are regulated by the USDA, while seafood and juice are regulated by the FDA.
