For land that has been in the program less than ten years, the penalty is 30% of the difference between the 100% valuation for the forest type and the fair market value of the land on the date of withdrawal. There is a sliding scale for land in the program longer than 10 years but fewer than 20 years.

The Maine Legislature passed the Tree Growth Tax Law in 1972 to help Maine landowners maintain their property as productive woodlands, where timber is harvested periodically, when they choose.

For 50 years, the Maine tree growth tax program has provided stability and supply to the forest products industry by providing tax incentives to landowners who manage their land for sustainable timber harvesting, allowing them to grow trees instead of houses and shopping malls.

Land can be withdrawn by the State Tax Assessor if the landowner does not have a management and harvest plan in place or if there is evidence that the landowner is not following the plan that is in place.

The penalty is equal to the taxes that would have been paid in the last five years if the property had not been in farmland, less the taxes that were paid, plus any interest on that balance.

The Maine Tree Growth Tax Law provides for the valuation of land that has been classified as forest land on the basis of productivity value, rather than on just value. The law is based on Article IX, Section 8 of the Maine Constitution that permits such valuation of forest land for property tax purposes.
