To find the owners and lessees of the mineral interests on the subject property, you can do your own research using the public records databases available in the with BLM records at: glorecords.blm.gov, Clerk and Recorder's Office, and the Assessor's Office, or you can hire an attorney or title company to perform the ...

The owner of the Mineral Estate has the right to use a reasonable amount of the surface to explore for oil and gas or grant a lease to an oil and gas company. In Colorado, it's common for surface rights and mineral rights to be severed and owned by different people.

By Colorado law, the mineral rights are considered the "dominant estate" and the surface owner may not prevent the mineral rights holder from "entering up and using that amount of the surface that is reasonable and necessary to explore for, develop and produce" the minerals.

The State Land Board owns approximately 1.2 million acres of mineral estate where the surface estate above is owned by another party (“split” or “severed” estate). Under Colorado law, the mineral estate owner is granted rights to access their mineral ownership, even if the surface is owned by another party.

Issues Regarding Severed or Split Estates Colorado recognizes the separate ownership of the Mineral Estate and the Surface Estate, each having distinct private property rights. When different parties own the surface and the subsurface - a common occurrence - this is referred to as a Severed or Split Estate.

By Colorado law, the mineral rights are considered the "dominant estate" and the surface owner may not prevent the mineral rights holder from "entering up and using that amount of the surface that is reasonable and necessary to explore for, develop and produce" the minerals.

A great place to begin is contacting your local Recording Department in the Clerk & Recorder's Office. Here you can find archived copies of property deeds, and you can research the mineral rights ownership to your land. The deed should specify the type of ownership at the time of the sale or transfer of ownership.

Severed mineral interests are considered real property in Colorado law, and as such are subject to taxation. In the Assessor's Office, once a mineral interest is severed from the surface property it is assigned a unique account number, and the interest is valued and taxed each year.
