Lack of Form applies to a marriage in which at least one person was a member of the Roman Catholic tradition prior to the wedding which occurred at a (civil or religious) place outside of the Catholic Church without the permission of the Church.

What is a Lack of Canonical Form case? If a Catholic is not married in the presence of a priest or deacon and has not received a dispensation from canonical form, then the Church's required form of marriage has not been followed and the Church does not recognize the union as a valid marriage.

There are three major causes of nullity, each of which can be further classified into several distinct grounds. A marriage can be invalid when there is 1) a defect in consent, 2) the presence of an impediment that rendered one or both of the parties unqualified for marriage, or 3) a defect in the form of celebration.

1127, §1 stipulates that the canonical form—i.e., the expression of consent of the contracting parties in the presence of a qualified witness (bishop or parish priest, or a priest or deacon delegated by either of them) and two other witnesses—is to be observed in mixed marriages.

The Church requires that a Catholic party must be married before a duly-authorized priest or deacon in the presence of two witnesses. This is called the canonical form of a marriage.

When Catholics fail to observe this law, the marriage is invalid. These “defect of form” cases account for more than half of all the annulments granted in the Catholic Church. A defect of form case can only come into play if one of the parties to the marriage is a Catholic (who has not left the Church by a formal act).

The nullity of marriage due to lack of canonical form (Canon 1108) occurs when a Catholic does not marry before a Catholic priest or deacon and two witnesses.
