While the statutory definition of substantial completion varies from state to state, most agree that a project is substantially complete when it can be used for its intended purpose. A construction project need not be absolutely complete; however, any remaining work or defects must be relatively minor and unimportant.

In construction, substantial completion is a legal term often used in contracts between project owners and contractors. It marks the point when the project is considered sufficiently complete. In general, this means that only minor, corrective, or warranty work remains.

Substantial Completion Definition Substantial completion means the project, or a portion of the project, is fit for its intended use. The owner can then occupy and use the property. The owner must also pay the contractor the last portion of the monies owed for that project or portion of the project.

The American Institute of Architects defines substantial completion as,”the stage in the progress of the Work when the Work or designated portion thereof is sufficiently complete in ance with the Contract Documents so that the Owner can occupy or utilize the Work for its intended use.”

In most contracts these days, final payment is released when the punch list items have been completed to meet the contract specifications. Once “punched,” the list is then typically attached to the Certificate of Substantial Completion.

Substantial completion is the stage when a construction project is deemed sufficiently completed to the point where the owner can use it for its intended purpose. This definition of substantial completion is based on the language in the American Institute of Architects form contract A-201: General Conditions.

Substantial Completion Punch List means a list of items of Work to be completed or corrected by DBE to achieve Substantial Completion. The items on the Substantial Completion Punch List are not priced. This list is not the Final Punch List that is prepared once Substantial Completion has been achieved.
