What is a W-8BEN-E Form? The form W-8BEN-E is also called a Certificate of Foreign Status of Beneficial Owner for U.S. Tax Withholding. It's an important document that enables a business operating outside of the U.S. to claim tax exemption on U.S.-sourced income.

Tax treaties generally allow you to exclude a specified amount of U.S.-source income on their U.S. tax return. This in turn reduces the tax liability because you do not have to pay taxes on that amount.

You are considered a Resident Alien with a Tax Treaty Benefit if you meet the following criteria: Have been in the U.S. as an F-1, or J-1 Student for more than 5 calendar years. Have been in the US as a J-1 non-student for more than 2 calendar years. Have been in H-1B status for 183 days or more during the past year.

The payee must file a U.S. tax return and Form 8833 if claiming the following treaty benefits: A reduction or modification in the taxation of gain or loss from the disposition of a U.S. real property interest based on a treaty. A change to the source of an item of income or a deduction based on a treaty.
