Untervermietung ist ein Mietvertrag zwischen Haupt- und Untermieter. Untervermietung ist zulässig, sofern der Hauptmieter ein berechtigtes Interesse daran hat. Eine Erlaubnis wird trotzdem benötigt. Der Vermieter muss dann aber seine Zustimmung zur Untervermietung geben.

Wollen Sie Ihre ganze Wohnung untervermieten, brauchen Sie grünes Licht vom Vermieter. Will er sich darauf nicht einlassen, können Sie seine Erlaubnis nicht erzwingen, sondern nur mit der üblichen 3-Monats-Frist kündigen. Dieses Sonderkündigungsrecht gilt auch bei einem befristeten Mietvertrag.

Will der Mieter nur einzelne Räume untervermieten, benötigt er dafür zwar auch die Zustimmung des Vermieters. Dieser muss einen Untermieter aber erlauben, wenn der Mieter ein „berechtigtes Interesse“ an der Untervermietung hat (Paragraf 553 Absatz 1 Bürgerliches Gesetzbuch).

Was ist Untervermietung und was nicht? Untermiete zeichnet sich dadurch aus, dass ein Untermieter Miete an einen Hauptmieter zahlt und dafür dessen Wohnung oder Teile der Wohnung nutzen darf. Auch Wohngemeinschaften (WGs) werden häufig über Untermietverträge organisiert.

Die Anzahl und Identität der Personen, an die untervermietet wird, die Höhe der Miete und die Info, ob die Wohnung nur teilweise oder ganz vermietet wird. Auch eine Kopie des Untermietvertrags muss auf Verlangen vorgelegt werden. Wenn Sie die Zustimmung eingeholt haben, steht dem Ganzen aber nichts mehr im Weg.

Die Gefahr bei einer Untervermietung liegt für den Vermieter immer darin, dass der Dritte unmittelbaren Besitz an der Wohnung erlangt - und dieser Besitz ist mit einer Reihe von Rechten verbunden.
