Process servers must operate within the law. They certainly can't break into someone's home to leave papers there. They can't trespass either. However, they can often wait outside someone's home as long as they are not trespassing on their property.

If a process server has exhausted other attempts to serve papers, there are two alternative options. They can serve the papers by mail, or they can leave the papers with another adult at the residence. These options should be used only as a last resort, especially if the individual is attempting to evade being served.

Process Servers Can Give Papers to Someone Else Again, one option when a process server is unable to serve someone is to leave them with another party. This must be an individual over the age of 18 who is able to understand why delivering the papers is important.

When service is to be made within this state, the person making such service shall make the service within five (5) days from the time of receiving the summons and complaint; but failure to make service within the five-day period will not invalidate a later service. Summons – Personal service.

You must complete a 12-hour, pre-certification class. You must pass an exam administered by the Administrative Office of the Courts. You must obtain a surety bond. You must pass a background check including fingerprinting and supplying a certified birth certificate.

A certified process server must supply and file a proof of service with the court in the county in which the action is pending within five business days of the service date. A certified process server shall not falsify or misrepresent the facts surround the delivery of legal process to any person or entity.

Rule 480-41-. A party filing a document or other submission with the Board shall simultaneously serve a copy of the document or submission on each party of record. Service shall be by personal delivery, e-mail as an attachment, first-class mail, certified mail, or statutory overnight delivery, return receipt requested.
