Anyone is allowed to take photos of anyone or anything in a public space. If the photo is for personal enjoyment, nothing else is required—you don't need a model release form or permission.

The consent form should include the name and telephone number of a person to contact for answers to questions and a person to contact in the event of a research-related injury or emergency. In the commercial photography industry, consent is always required if the people in the image are identifiable and the image is used for commercial purposes to promote a product, service, or individual.

I understand that my image may be edited, copied, exhibited, published or distributed and waive the right to inspect or approve the finished product wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of my image or recording.

Information to include. Names of both parties and whether they're giving or receiving permission to use the photo. Brief description of the images, the photographer, and the date. Details about the permission, including specific publishing methods allowed, naming conventions, etc.

Additionally, even if you only provide cosmetic ® treatments, since ® Cosmetics is considered a prescription drug by the FDA (see .fda.gov), HIPAA would consider your practice a covered entity.

What is a Non-Covered Entity Under HIPAA? As mentioned above, a non-covered entity is an entity that is not subject to the requirements of the HIPAA Privacy Rule. There are two types of non-covered entities under HIPAA: business associates and hybrid entities.

This is to ensure that you have their permission to use the photo. Once you have the form, fill it out and have the person in the photo sign it. Once it is signed, you will have permission to use the photo. You could be opening yourself up to legal trouble without a photo release form.
