AB 1949 provides eligible employees with up to five days of bereavement leave upon the death of a qualifying family member. The five days of bereavement leave provided under AB 1949 are separate and distinct from the 12 weeks of leave permitted under CFRA – it is an additional form of protected leave.

The California Family Rights Act (CFRA) entitles employees to five days of unpaid bereavement leave. Bereavement leave (sometimes called grievance pay) is time off of work given to eligible employees after the death of a family member or a loved one.

4: BEREAVEMENT LEAVE. (a) Definition. Bereavement leave is paid leave which is available to an employee at the time of death or funeral of a member of the employee's immediate family as defined below in section 4.2. 4(e).

An eligible employee may be granted an excused absence of not more than three days to make arrangements for or to attend the funeral or memorial service for an immediate relative who died as a result of wounds, disease, or injury incurred in a combat zone as a member of the Armed Forces (5 U.S.C. 6326).

Compassionate leave, also known as bereavement leave, can be taken when a member of your immediate family or household dies or contracts a life-threatening illness or injury. Both full-time and part-time employees have the right to take two days of paid compassionate leave per incident.

The purpose of bereavement leave is to allow time for grieving, to plan and attend the funeral, and to handle business or financial matters related to the deceased.
