A landlord must first serve a notice of intention to bring proceedings on the tenant. [1] The notice is commonly referred to as a 'notice seeking possession' (NSP) or a 'section 8 notice'. Section 8 Housing Act 1988 requires the notice to state a date after which possession proceedings can start.

Serving section 8 notice. If the tenant ignores letters and other efforts to mediate or remedy the rent arrears, you can serve legal notice on the tenant; the notice is called a section 8 notice (because it's served under section 8 of the Housing Act 1988).

You must file for eviction and carbon-copy the PHA. It is possible for a renter to lose their subsidy for bad behavior, but it is rare. Additional legal requirements may apply depending on the program. Contact an attorney before taking any action that could affect your rights in a Section 8 tenancy.

Eviction Procedures Section 8 tenants may be evicted for serious or repeated violations of the lease and/or violations of Federal, State, or local law that impose tenant obligations regarding use of the unit. The LACDA is not a party to the lease and is therefore, not involved in the eviction process.

It takes about 3 days to 3 years from the issuance of the Notice to Pay/Quit to begin filing to evict a tenant. This depends on the reason for eviction.

Unlike a section 21, a section 8 eviction notice can only be served if the tenant has: Breached the tenancy agreement. Been in rent arrears for over two months. Used your property to perform criminal activity.

Your landlord must send you a "14-Day Notice to Quit" if terminating your tenancy for non-payment of rent (M.G.L. c. 186, § 12). If it is being terminated for any other reason, you must be given written notice 30 days, or one full rental period in advance, whichever is longer.

If you get a section 8 notice, it's the first step your landlord has to take to make you leave your home. You won't have to leave your home straight away. If your section 8 notice is valid, your landlord will need to go to court to evict you. You might be able to challenge your eviction and stay longer in your home.
