You can build on wetlands as long as they're not jurisdictional, but that doesn't mean you won't be fighting an uphill battle. When wetlands are filled, the water that makes them wet has to go somewhere. If you're building on these lands, you have to consider that your home or business may be damaged by this water.

State wetlands regulation requires that you obtain a permit from the N.H. Department of Environmental Services (“DES”), prior to undertaking any excavation, removal, filling, dredging or construction activity in and adjacent to waters of the State, or in wetlands (i.e., below the mean high water line).

For Wetland/Shoreland Technical Questions: If you have a general technical question about wetlands or shoreland jurisdiction or regulatory permitting, please contact (603) 271-2147 and the receptionist will direct your call to the Inspector of the Day (Monday-Friday, 8 AM - 4 PM).

A Wetlands Permit from the NHDES Wetlands Bureau is required for excavating, removing, filling, dredging or constructing structures within the following areas: Wetlands, such as forested, scrub-shrub, emergent wetlands, marshes, wet meadows and bogs.

You must file Wetland Permits with the Town Clerk for a $10.00 fee. You may obtain application forms from the DES Wetlands Bureau.

“Wetlands" means an area that is inundated or saturated by surface water or groundwater at a frequency and duration sufficient to support, and that under normal conditions does support, a prevalence of vegetation typically adapted for life in saturated soil conditions. Q.
