You can also have a Trust fund for your pet within your Will ring fencing a specified sum that is to be used purely for your pets benefit.

It is possible to have a trust for the maintenance of a specific animal or animals. In relation to private non charitable trusts this is one of two exceptions to the beneficiary principle. For a trust relating to a horse see Pettingall v Pettingall which was decided in 1842.

In California, a pet trust is primarily used to allocate funds and any wishes on behalf of a pet. This can be done in several different ways. A pet trust can be made through a will, as a part of a revocable living trust, or a stand-alone trust.

Besides providing peace of mind that your pet will be taken care of should you no longer be around and depending on the current legislation in your state, pet trusts can be a legally enforceable method to provide for your pet's long-term care.

As you can imagine, we get asked now and again whether it's possible to leave money or property to pets in a Will. The short answer to this is 'no, you can't'. Well, not directly anyway. Gifts that you make in your Will must have an identifiable human beneficiary.

A pet trust is a legally sanctioned arrangement providing for the care and maintenance of one or more companion animals in the event of a grantor's disability or death.

As such, setting up a pet trust requires: Identifying the right trustee. Providing their name and address. Identifying a successor trustee (should the first refuse or pass away). Identifying a separate caregiver (if you wish). Providing adequate identification for your pet (DNA samples, microchips, and more).

But in the eyes of the law, pets are considered property, and you can't use your will to leave them an inheritance. However, you can still provide for your pets' care when you make a will by naming a “pet guardian,” a.k.a. a beneficiary for your pet.
