The minor components waiver is appropriate for FEMA programs because it would reduce administrative burden by not requiring manufacturers to track and count these minor components in otherwise compliant domestic steel and iron products.

Important Note About Other Domestic Preference Requirements: The AIS requirement is not the same as Buy American, Made in USA, Buy America Act, or any state domestic preference requirements.

The American Iron and Steel (AIS) provision requires USDA Rural Utilities Service (RUS) Water and Environmental Programs (WEP) assistance recipients to use iron and steel products that are produced in the United States.

The AIS De minimis waiver applies to miscellaneous non-domestically made, low-cost components tracked in the De Minimis Tracking Report. The cumulative costs for these components may not exceed 5% of the total project cost. The cost of a single item may not exceed 1% of the total project material costs.

All projects are encouraged to consider utilizing the de minimis waiver for items incidental to the primary purpose of the project. One item cannot exceed 1% of the total material costs and all items using the de minimis waiver cannot exceed 5% of the total material costs.

22) What is not considered a 'construction material' for purposes of the AIS requirement? Mechanical and electrical components, equipment and systems are not considered construction materials. Mechanical equipment is typically that which has motorized parts and/or is powered by a motor.
