If your employer does not pay your wages within 14 days after you've sent your written demand, you may be able to recover extra penalties from your employer in addition to the wages you are owed, through the Division's complaint process or by filing in court.

If you receive a late paycheck, California Labor Code 210 requires employers to pay a penalty of $100 for an initial violation. For subsequent offenses, the penalty is $200 plus 25% of the amount your employer unlawfully withheld. This higher penalty may also apply to a first violation if it was deliberate.

Ann. § 8-4-109, when an employee is fired, the employer must give him or her a final paycheck immediately, or within six (6) hours of start of the next business day if the payroll office is closed, or within twenty-four (24) hours if the payroll office is offsite.

The 15 days begins on the day the employer receives a notification in writing from the employee. You can check your state's department of labor website to learn about the labor laws that apply to your business.

If an employer fails to pay all earned wages, the employee may make a written demand for payment. After receiving the written demand, the employer has 14 days to pay the full amount owed to the employee.

If the employer does not pay within 14 days, an employee can commence a civil action to recover the final paycheck funds. An employer that fails to pay the final paycheck could, in addition to the wages owed, be ordered to pay a penalty to the employee.

The Colorado Wage Act If your employer didn't pay you, they may be forced to pay you two times what you're actually owed and be responsible for your attorney fees if they do not pay your wage claim within 14 days of the demand. That penalty increase to three times the wages owed for willful nonpayment.

Colorado wage law does not require that an employer pay an employee for what is commonly referred to as "show-up time" or "reporting time pay".

Beginning January 1, 2023, employers that do not pay wages owed within 14 days will face an automatic penalty of the greater of: (1) two times the amount of the unpaid wages or compensation; or (2) $1,000. Thus, in most cases, the penalty will be increased from 1.25 to two times the amount owed.

If the employer fails to pay the wages to the employee as required by the Act, the employee has the right to file a written demand. If the employer does pay the wages within 14 days of the demand, the employee may be able to recover a significant penalty by filing a civil lawsuit.
