Occurs when both principal parties in the same transaction are represented by a fiduciary without full disclosure to and approval from all parties in the transaction.

Undisclosed dual agency is a dual agency relationship that is not disclosed and agreed to in writing. If this situation occurs, the agent has breached his or her fiduciary responsibilities to the client.

Dual agency occurs when an agent is representing both the buyer and the seller. Disclosure is of the utmost importance in cases of dual agency, as it is still the fiduciary duty of the agent to represent the interest of both clients. Dual agency is illegal in some states.

A licensee may act as a dual agent only with the informed written consent of all clients. Informed consent shall be presumed to have been given by any client who signs a dual agency disclosure form prepared by the commission pursuant to its rules and regulations.

Advance consent to dual agency means written informed consent signed by the seller/landlord or buyer/tenant that the listing agent and/or buyer's agent may act as a dual agent for that seller/landlord and a buyer/tenant for residential real property which is the subject of a listing agreement.

The buyers and sellers will need to provide written permission to the agent to move forward if the topic of dual agency comes into the picture. Without written consent from both parties, a dual agent will not be able to represent both parties.

The seller and buyer both provide written consent in advance: When both clients to the transaction (i.e., the buyer and the seller, or the landlord and the tenant) provide their written consent, a broker may simply let both clients know orally when a dual agency situation arises. No other consent is needed.
