This penalty can be waived if the taxpayer establishes, to the satisfaction of the IRS, that the shortfall in the amount of distributions was due to reasonable error and that reasonable steps are being taken to remedy the insufficient RMDs.

Minimize RMD Taxes With a Roth Conversion If you have assets in a tax-deferred account, you could avoid RMDs and their associated taxes by rolling the balance into a Roth IRA. This is done through a Roth conversion in which you essentially turn tax-deferred assets into tax-free ones.

Under this relief, the Internal Revenue Service (IRS) will not consider an RMD statement provided to an IRA owner who will attain age 72 in 2023 to have been provided incorrectly if the IRA owner is notified by the financial institution no later than April 28, 2023, that no RMD is actually required for 2023.

Avoid Taxes on RMDs by Working Longer One of the simplest ways to defer RMDs and the taxes on those withdrawals is to continue working. If you're still working at age 73 or beyond and contributing to an employer's 401(k), the IRS allows you to delay taking RMDs from those accounts.

Prior to the SECURE 2.0 Act, the age to start RMDs was 72 for retirement accounts including traditional IRAs and 401(k)s. The new law raises the RMD age in two steps. The RMD age increases to 73 beginning in 2023. In 2033, the RMD age will further increase to 75.

(updated March 14, 2023) If an account owner fails to withdraw the full amount of the RMD by the due date, the amount not withdrawn is subject to a 50% excise tax. SECURE 2.0 Act drops the excise tax rate to 25%; possibly 10% if the RMD is timely corrected within two years.

However, you may qualify for an exception from taking RMDs from your current employer-sponsored retirement account, such as a 401(k), 403(b), or small-business account, if: You're still working. You do NOT own more than 5% of the business you work for.

Required minimum distributions pushed to age 73 The RMD age changes again in 2033 from 73 to 75. SECURE 2.0, effective for distributions made after December 31, 2022, increases the RMD age to 73 for those IRA owners (including SEP and SIMPLE, but not Roth IRAs) who turn 72 after December 31, 2022.
