Louisiana is a community property state. All property and debts acquired during the marriage are typically split equally, unless the spouses have a legally binding agreement or are subject to a court ruling to the contrary.

Separate property is property belongs exclusively to one of two spouses. Under Louisiana law, assets acquired by a deceased person while unmarried, or acquired during the marriage by gift, is considered to be separate property.

Separate property brought into the marriage that loses its identity by commingling, replacement, etc., becomes community property. Upon termination of marriage, separate property funds used for the benefit of the community are reimbursed to the spouse whose separate property was used in the amount of 50%, not 100%.

In Louisiana, community property is typically divided equally by a 50/50 split of the net value of the marital estate. The net value of the estate simply means the value of community property after accounting for any community debts.

If your spouse died without any descendants, all of your spouse's community property becomes your separate property. You will own your share and your spouse's share of the community property outright as separate property once your spouse's succession case is settled.

Article 103 no-fault divorces are for spouses who have already been living separate and apart for the required waiting period, which is either 180 or 365 days. If there are no minor children, or if there is physical or sexual abuse, then the waiting period is 180 days.

More specifically, community property includes: Any property acquired during marriage, regardless of how that property is paid for. Gifts or inheritances that were given to both spouses jointly. Appreciation in value, dividends, or other income from community property or from separate property.
