Cohabitation implies that the parties are having sexual intercourse while living together, but the definition would not apply to a casual sexual encounter.

Virginia does not have common law marriage. No duties or obligations arise between two adults by living together in the same household unless such duties or obligation are set out by express agreement.

Virginia courts may terminate spousal support “upon clear and convincing evidence that the spouse receiving support has been habitually cohabitating with another person in a relationship analogous to a marriage for one year or more,” pursuant to Virginia Code § 20-109(A).

Since Virginia law fails to recognize cohabitation as either a marriage or civil partnership, a cohabitation agreement can provide unmarried couples with a layer of protection they would not otherwise be entitled to.
