Petition for Probate (DE-111) Ask the court to start the process for distributing a deceased person's property, paying debts owed by the deceased person, and settling the financial affairs of the deceased person. Get form DE-111.

Assets Subject to the California Probate Court Probate assets include any personal property or real estate that the decedent owned in their name before passing. Nearly any type of asset can be a probate asset, including a home, car, vacation residence, boat, art, furniture, or household goods.

If the value exceeds $50,000, then probate will be required to transfer the asset to the Trust. In order for a Trustee to gain access to such an account or asset, you must wait 40 days following the decedent's passing, complete an affidavit procedure, and present the death certificate.

Is there a California probate minimum? Yes. For an estate to require a formal probate, it should generally be worth more than $184,500, which is the minimum value required as of April 1, 2022.

For decedents who died prior to April 1, 2022 the California Probate Code provides that probate estates of $166,250 or less do not need to be probated. Deaths on or after April 1, 2022 the threshold amount is $184,500.

The executor of your will and the individuals named in it are not required to go through the probate procedure in California if the value of your estate is less than $184,500.00. However, the probate process is necessary for estates worth more than this amount.

What must I do to close the estate? The Personal Representative must file a final account, report and petition for final distribution, have the petition set for hearing, give notice of the hearing to interested persons, and obtain a court order approving the final distribution.
