The Static-99 is a second-generation (see Bonta, 1996), “atheoretical” risk assessment instrument. The Static-2002 contains items that were intended to measure conceptually meaningful constructs, such as sexual deviancy, general criminality, and persistence. The STATIC-99 is an actuarial risk prediction instrument designed to estimate the probability of sexual and violent reconviction for adult males who have already been charged with or convicted of at least one sexual offense against a child or a non-consenting adult.

California has adopted four risk assessment instruments for use in assessing sex offender risk of reoffending. The first one, the Static-99R, is used to assess male sex offenders presentencing and prior to release from prison.

While licensed mental health professionals typically administer the Static-99R as part of an assessment, parole agents and probation officers are also commonly trained in the administration, scoring, and interpretation of the instrument.

The STATIC-99 report is used by the judge in sentencing defendants for serious sex crimes. The judge will use the report as a reference point in sentencing the defendant. The lower the risk score the more likely the judge will impose a lighter or more lenient sentence.

The Static-99R score is used to predict risk of sexual reoffense, based on the offender's score category. In 2016, the authors of the Static-99R revised the coding rules to reflect new score literals for each numeric score.
