Civil Indigent Status In a civil proceeding, if a person is determined to be indigent their filing fee, cost of summons, and cost of service by the Sheriff are waived pursuant to Florida Statute.

You must fill out a form called an Affidavit of Indigency. This form tells the court you cannot afford the fees related to your case.

(a) An indigent person is a person who is financially unable to secure legal representation and to provide all other necessary expenses of representation in an action or proceeding enumerated in this Subchapter.

File your Application for Determination of Civil Indigent Status when you file for the first time in your case. You may file in person at one of our office locations, by mail or online using the Florida Courts E-Filing Portal. Free viewers are required for some of the attached documents.

A person is referred to as indigent when they are impoverished, or unable to afford the basic necessities of life. A defendant who is indigent has a constitutional right to court-appointed representation, ing to a 1963 Supreme Court decision, Gideon v. Wainwright.

Your income, after taxes, does not exceed 125% of the current Federal Poverty Line.

You must first fill out and file an affidavit of indigency form. When you file, the district clerk will set a hearing date. At the hearing, you present your financial situation to a judge and ask them to waive filing fees. If the court approves your request, you can move forward without paying these fees.
