Filing the affidavit is a two step process. First, the affidavit is filed in the probate court in the county where the property is located, along with a certified copy of the death certificate, and the original will if there is one. Second, a certified copy of the affidavit must be recorded in the same county.

To qualify for a small estate probate in Colorado, the estate must not contain any real property (i.e. land, homes, buildings, etc.) and the decedent's personal property must be less than $74,000 (As of 2022).

The fair market value of property owned by the decedent and subject to the disposition by will or intestate succession at the time of his or her death, wherever that property is located, less liens and encumbrances, does not exceed seventy thousand dollars ($70,000).

Whether or not you have a will when you die, if you have $50,000 or less in personal property (includes bank accounts and cash) and no real property, your devisees or heirs may collect your assets by using an affidavit and not have to open a probate action through the court.
