For Restitution to be valid, it must be ordered by a Judge. If the defendant is released from Probation, jurisdiction no longer exists for the court to order Restitution. The only remedy for the victim then is to file a civil claim against the defendant.

Restitution holds offenders partially or fully accountable for the financial losses suffered by the victims of their crimes. Restitution is typically ordered in both juvenile and criminal courts to compensate victims for out-of-pocket expenses that are the direct result of a crime.

These may include drunk driving, domestic violence, sexual assault, child abuse, identity theft, and financial elder abuse. Restitution also is very common in theft crimes, white collar crimes, and other cases in which a victim suffered a direct financial loss.

Restitution means “paying back.” A law dictionary defines restitution as an, “act of restoring; restoration; restoration of anything to its rightful owner; the act of making good or giving equivalent for any loss, damage or injury.” The purpose of restitution fines or direct order of restitution is to help victims ...

At sentencing, the judge then enters an "Order for Restitution," directing the offender to reimburse victims for some or all of the offense-related financial losses. Compliance with the Order of Restitution automatically becomes a condition of the offender's probation or supervised release.

If restitution is ordered by the judge in disposition of case, the Restitution Program: Collects payment(s) from the defendant(s) or probationer(s) in the form of money order, certified bank check, or credit card. Cash will not be accepted. Payments can be made by mail, online or in-person by scheduling an appointment.

Are there different types of restitution? There are three different types of restitution: restitution fines, parole revocation fines, and direct orders. The court can order all three types of restitution in the same case.

Examples of restitution might include a shoplifter who is ordered to repay a store owner for the cost of a stolen item, or an assailant who must pay for their victim's medical expenses after a violent assault. In homicide cases, restitution can even cover funeral costs.
