The Commonwealth of Virginia recommends that an estate's executor file for probate at the appropriate Virginia Circuit Court within 30 days of the decedent's death.

A: The certificate of qualification, sometimes referred to as “letters testamentary,” is the certificate that the personal representative receives from the Clerk at the time of qualification, which states that the person has qualified as executor or administrator and has authority to act on behalf of the estate.

The probate tax is imposed on the probate of most wills and grants of administration, and applies to property in Virginia. No tax is imposed on estates valued at $15,000 or less. The tax does not apply to the following types of property within an estate: Property passing by the exercise of a power of appointment.

A: A personal representative or person offering a will for probate is required to provide written notice of probate and qualification and of entitlement to copies of wills, inventories, accounts, and other reports, to beneficiaries and heirs.

Waiver of Qualification. This form is used to evidence the decision not to serve as a personal representative by a person appointed in the will to serve or having preference of appointment under the law.

There is no set time frame in which a will must be probated, or estate administration must be started. The death of a loved one is a particularly emotional, stressful, and busy time.

Length and Commitment of Process Generally, there is a creditor period, so an estate cannot be completely distributed and closed prior to the expiration of the six-month period.

Compensation for an executor in Virginia is the sole discretion of the court which has jurisdiction over the estate. As a general guideline, an executor is entitled to whatever fee is fixed by the will. Where a specific fee was not fixed, the courts have considered reasonable a fee equal to 5% of the assets.
