A "Power of Attorney" is a written document often used when someone wants another adult to handle their financial or property matters. A Power of Attorney is a legal form but is NOT a court form. A Power of Attorney cannot be used to give someone the power to bring a lawsuit on your behalf.

Except with respect to real estate transactions, a Minnesota Power of Attorney document does not need to be recorded anywhere in order to be effective.

Manner. An executed power of attorney may be revoked only by a written instrument of revocation signed by the principal and, in the case of a signature on behalf of the principal by another or a signature by a mark, acknowledged before a notary public.

"Durable power of attorney for health care" means an instrument authorizing an agent to make health care decisions for the principal if the principal is unable, in the judgment of the attending physician, to make or communicate health care decisions.

When a power of attorney is considered “durable,” it remains valid even if you become incompetent or incapacitated. An ordinary power of attorney expires if a person becomes unable to make his or her own decisions.

While Minnesota technically requires you to get your POA notarized only if someone else is signing the document on your behalf (Minn. Stat. § 523.01), notarization is very strongly recommended. Many financial institutions will require a POA to be notarized (even if state law doesn't require it) before they accept it.

A regular power of attorney will become invalid when a person is incapacitated or passes away. However, a durable POA is the most pervasive and encompassing type of POA. This type of POA only expires upon the death of the individual, not upon incapacitation.
