What are the differences between a lease and a tenancy? Leases and tenancies are different on two levels. At surface level, a lease is simply a rental agreement for a longer duration. Specifically, a lease must be at least above three years, whilst 'leases' for a term of three years and below are termed 'tenancies'.

The NLC distinguishes between “leases,” which have a term exceeding three years (and are required to be registered) and “tenancies,” which have a term up to three years (and are not registrable).

Under the National Land Code all leases have to be registered. Registration results in the fact of the letting to be endorsed on the title deed and therefore in the Register of Titles. In fact a lease that is not registered is said to be void.

The NLC distinguishes between “leases,” which have a term exceeding three years (and are required to be registered) and “tenancies,” which have a term up to three years (and are not registrable). Registration of a lease s a tenant certain rights against future owners of the land.

Therefore, the NLC 1965 requires you to register your lease agreement by submitting a form to the Land Office. Being literally termed 'tenancies exempt from registration', tenancies cannot be registered under the NLC 1965. However, one may still endorse a tenancy by making a written application to the Registrar.

Hence, for lease to be effective, it must be registered by submitting Form 15A as provided under the NLC 1965. Once registered, a lease will create a legal interest in the said property by making it enforceable against the third party and parties of the lease agreement will enjoy protection under the law.
