Since guardianship usually does not require ter- mination of parental rights, the child is able to maintain family connections while gaining the stability of a permanent home with a relative caregiver who has demonstrated a commitment to caring for the child.

The child's parents can no longer make decisions for the child while there is a guardianship. The parents' rights are suspended—not terminated—as long as a guardian is appointed for a minor. If you wish, you may ask the parents for their opinions about matters relating to the child.

You may file a petition for temporary or concurent custody by an extended family member if: You have physical custody of the child(ren) and have had physical custody of the child(ren) for at least ten (10) days in any 30-day period within the last 12 months.

Importantly, the emergency temporary guardianship only lasts for 90 days, so it is specifically designed to be temporary (hence the name) until a full guardianship hearing can be held. A court hearing must still take place to confirm that even an emergency temporary guardianship is necessary.

"Temporary guardian." A family member appointed by a court for a limited period as a guardian of the minor when the minor's custodial parent has entered a rehabilitation facility for treatment of drug or alcohol addiction or has been subject to emergency medical intervention due to abuse of drugs or alcohol.

Abandonment The timeline to be considered abandonment is based on the child's age. A child under the age of three is considered abandoned by their parents if contact has not been made for at least six months. For children over the age of three, it is considered abandonment after a year.

If you are a Georgia resident you must file the petition for temporary guardianship in the county of your domicile. If you are a non-resident of this state you must file the petition in the county where the minor is found and you must have physical control of the minor at the time of filing the petition.

A guardianship is typically a temporary arrangement that establishes legal custody for the child's current caregiver. Unlike in adoption, parental rights are not terminated in guardianship; a parent can file a petition to terminate the guardianship and regain legal custody of their child at any time.
