Formerly the Business Privilege Tax, BIRT applies to every entity doing business in the City of Philadelphia, whether or not they earned a profit during the preceding year. The BIRT is a two part tax on gross receipts and net income and both parts must be filed.

The Philadelphia statute of limitations for business wage tax is six years for collecting the tax. The general limitation for an assessment of tax is three years from the latter of the due date for the filing of a tax return or the actual filing date of the tax return.

The City of Philadelphia has reduced the tax rate for the net income portion of its Business Income and Receipts Tax (BIRT) from 6.20% to 5.99%. The BIRT applies to gross receipts and taxable net income for business activities conducted in Philadelphia. The new rate is effective for tax year 2022.
