What happens if the defendant doesn't pay? If the defendant does not pay, it is up to you to ask the court to take further action, called 'enforcing the judgment'. The court will not do anything unless you ask it to.

Procedure for obtaining a default judgment for costs only (a) if the claim is for fixed costs, they may obtain it by filing a request in the relevant practice form; (b) if the claim is for any other type of costs, they must make an application in ance with Part 23.

If the defendant doesn't respond within 14 days, the court automatically makes an order requiring the defendant to pay the amount claimed. This is known as a default judgment.

Orders of default judgment (aka judgment in default) are obtained in two different ways: by using an administrative process – a Request - judgment is entered by a court officer; or. by filing an application for Judgment in Default, with a Form N244 Application Notice.
