Talk to Your Landlord You may be able to come to an agreement without going to court. An eviction will cost both of you money (as well as time), and your landlord may be willing to stop the eviction if you agree to certain terms, such as paying rent you owe or stopping behavior that violates the lease.

Tenants have 3 days to vacate the property before they will forcefully be removed. In cases of nonpayment of rent, the tenant is not evicted if they pay all owed rent in full. In cases where a stay of execution or an orderly removal was issued, their move-out period may be extended for 7 days to 6 months.

Having an eviction on your record can be a major red flag and make it difficult to find a rental that meets your needs. Evictions stay on your record for seven years, but many people are not the same person they were seven years ago.

A typical New Jersey eviction process will take anywhere from 6 weeks to 6 months but they can drag on for much longer if you aren't careful. Below is a broad overview of what you can expect in the NJ eviction process.

If the tenant does not move after three (3) business days from the time the warrant for possession was served on the tenant, the landlord may arrange for the Court Officer to have the tenant evicted or locked out. Following the eviction, the landlord must let the tenant remove personal belongings from the premises.

Rent is still due, and you should pay if you can. Even if you are eligible for protection from eviction under the new state law, your landlord can sue you to collect any rent that you owe.

If the landlord fails to return the tenant's security deposit within 30 days, then the tenant is entitled to sue the landlord for the return of the security deposit.

They cannot be evicted by anyone other than a special civil part officer. The landlord must first file a landlord tenant lawsuit in the special civil part of the Superior Court and get a judgment for possession from the court before an officer can be directed to evict any residential tenant.
