Is there a statute of limitations on filing for paternity actions? Yes. In Florida, the time limit to determine a child's paternity is four years after the child reaches the age of majority. The age of majority in Florida is 18 years old.

Section 63.054, Florida Statutes, provides for the establishment of a Putative Father Registry in the Bureau of Vital Statistics. The purpose of the registry is to permit a man alleging to be the unmarried biological father of a child to preserve his right to notice and consent in the event of an adoption.

If the test results prove that the man believed to be the father is the biological father, we issue an Administrative Order of Paternity and tell the Florida Bureau of Vital Statistics to add the father's name to the child's birth certificate.

Paternity Acknowledgement Additionally, if both parents are not present at the time of the child's birth, they have the ability to print an Acknowledgment of Paternity form online from the Florida Department of Revenue. The form must be completed by both parents, notarized and sent to the Office of Vital Statistics.

But, what happens when the father decides to pursue a relationship with the minor child? Florida does not have a presumption rule for 50/50 custody, however, if the father proceeds and establishes legal paternity, the father may be awarded shared parental responsibility and 50/50 timesharing.

To disestablish paternity or terminate a child support obligation, the male must file a petition in the circuit court having jurisdiction over the child support obligation. The petition must be served on the mother or other legal guardian or custodian of the child.
