The three main types of probate in Arizona are Informal, Formal, and Supervised. Much of the difference depends on the amount of court supervision required to complete the process. Additional types of probate exist but are not as common.

The probate process can take about 12-18 months. Per Massachusetts law, “an estate must be probated within three years.” Many factors can delay the probate process. As a Massachusetts probate lawyer, I can help work to avoid the delays and ensure that any complications that occur are resolved quickly.

Informal probate requires that the deceased had a valid will at the time of death that has not been challenged and died less than 2 years before probate is opened. In an informal probate process, a personal representative is appointed by the court to administer the estate with minimal court supervision.

A Formal Administration requires the assistance of an attorney. Informal Administration may be granted without an attorney's assistance. Informal Administration is the administration of the decedent's estate without continuous court supervision, and is supervised by a Probate Registrar.

Informal probates typically last between 6-8 months, depending on how quickly the Personal Representative completes their required duties. Formal and Supervised probates can last a year, or longer, depending on the complexity of the case.

The Arizona Probate Code requires that heirs and devisees of an estate be given notice of an application for an informal probate proceeding. After being given notice, an heir or devisee has four months to challenge the will and trigger a formal probate proceeding.

Informal probate is designed for estates in which a court adjudication is not required nor court supervision needed, and only for estates without uncertainties, legal disputes, or complex administrative requirements.
