If your circumstances change while the garnishment is in effect, you may file a new answer form at any time.

After a creditor has obtained a judgment against you to begin garnishing your wages, one way to put an immediate stop to it is by filing for bankruptcy protection.

If the person who owes money does not file an answer, the garnishment commences and can last for 13 weeks after the notice. The garnishment period can extend longer than 13 weeks if both parties agree in writing.

Wisconsin imposes stricter limits than federal law, limiting a garnishment to 20% in most cases. The creditor will continue to garnish your wages until the debt is paid off, or you take some measure to stop the garnishment, such as claiming an exemption with the court.

A judgment can remain on your credit report for seven years or until the statute of limitations expires, whichever is longer. In Wisconsin, the statute of limitations on a judgment can be up to 20 years.

For an earnings garnishment to begin, you must also serve the debtor with the following documents: 1) One (1) copy of the Earnings Garnishment given to you by the Clerk of Court; 2) One (1) copy of the Earnings Garnishment – Exemption Notice, (CV-423) form; 3) A blank copy of the Earnings Garnishment – Debtor's Answer, ...

Garnishment is good for 13 weeks unless debtor agrees to continued withholding in writing. Must renew every 13 weeks add cost to debtors owed amount. The first 80% of the debtor's disposable earnings are exempt from garnishment. All earnings may be exempt in some cases.

Wisconsin law puts limits on how much of a person's wages a creditor may garnish. In general, a creditor may not take more than 20 percent of a person's net income, and only one creditor may garnish a person's wages at a time.
