Final PFAs can be permanent (have no expiration date) unless the judge says otherwise or the order is later modified (changed). Once the hearing date is set for the final PFA, you must attend that hearing or else your temporary order may expire and you will have to start the process over.

A: A PFA order is entered against the Defendant, and not against the Plaintiff. So in most PFA situations, there is no violation if the Plaintiff contacts the defendant- unless the defendant responds.

An ex parte protection order tells your abuser not to bother you. He shouldn't hit you, push you, shove you, harass you or intimidate you. It does not make him leave the house. It does not order him to stay so many feet from you.

Under Ala. Code § 30-5A-3, violating a protection order is a Class A misdemeanor which carries a sentence of up to a year of imprisonment and/or a $6,000 fine.

A restraining order is a legal document issued by the Alabama courts that orders one party to stay away from another. Also referred to as a protective order, this mandates that person named refrain from contacting you and stay a certain physical distance away from you at all times.

Restraining Orders Step 1: Go to court to get the petition. Step 2: Fill out the necessary forms and file them with the clerk. Step 3: Go in front of the judge (the ex parte hearing). Step 4: Service of process. Step 5: The final PFA hearing.

PROTECTION ORDER ENFORCEMENT Orders issued by Alabama Courts are enforceable under Alabama law. A willful violation of a protection order is a Class A misdemeanor and the officer may arrest without a warrant when there is probable cause that the defendant has violated a valid protection order.

Ex parte orders are temporary orders that do not require the abuser to be notified beforehand. They last until the court hearing on a final order. To get a temporary ex parte order, you must show that you are in danger of likely, future harm. A judge issues a final order after notice to the abuser and a court hearing.
