Learn about the important reasons why a lawyer should represent you at your disability hearing. The Social Security Act and its corresponding regulations are a complex area of law, so it's always advisable to hire a lawyer for your Social Security disability hearing.

You can expect to wait anywhere from six months to two years for a hearing date. Disability applicants who have already gone through the initial application and reconsideration phase of a Social Security disability (or SSI) case need to request an appeal hearing to get a judge to hear their case.

A Social Security disability or SSI case for which a hearing has been requested can also be expedited by requesting what is known as an on-the-record (OTR) review. In an OTR request, you ask that your file be reviewed prior to a hearing date.

The first circumstance occurs when the decision is fully favorable. In other words, if the evidence in the hearing record supports your case on every issue, the ALJ may issue their decision based on a preponderance of the evidence without holding a hearing.

A request for a hearing can be completed online at: www.ssa.gov. If needed, we can help you complete this form. You or your representative must request a hearing within 60 days after you get the notice of reconsideration determination (or, in rare cases, the initial determination).

In an ideal world, the ALJ would just tell you at the end of your hearing if you were going to be approved for disability benefits. And, occasionally, that does happen; a judge may tell you that your claim has been successful, and you can expect to receive a written decision after the hearing.

You may be more comfortable if you know what kinds of questions to expect during the hearing. The administrative law judge will likely ask you for your name, Social Security number, age, mailing address, height and weight. After that, you should be prepared to answer questions such as: What is your formal education?
