How long are claims files kept by the Court? Workers' compensation claims files and their contents are kept for 25 years if a death claim, or for 10 years for all other claims, and then destroyed as provided by law. The records are destroyed annually based on the disposition schedule.

To be eligible for wage benefits, the injured employee must be deemed disabled by a physician and must not have worked for a minimum of three (3) days. Waiting Period: There is a three-day waiting period in Oklahoma.

Amount: compensation is equal to 70% of the difference between the employee's average weekly wages and the employee's wage-earning capacity in the same employment or otherwise, if less than before the injury. It may not exceed 80% of the employee's average weekly wages at the time of the accident.

The form is listed under Affidavit of Exempt Status on the Case OK website. The cost for an Affidavit of Exempt Status is $50.00 plus a $1.00 online processing fee. Please note the Workers' Compensation Commission will not accept checks for the Affidavit of Exempt Status Fee.

A claim for compensation for injury (CC-Form-3) must be filed within one (1) year of the date of injury. Other types of claims for compensation have different filing deadlines. Failure to comply with the deadlines may cause the claim to be forever barred. Claims forms are on the Commission's website, .wcc.ok.gov.

The Form 36 is to be completed by the respondent (employer/workers' compensation insurance carrier) to notify the Workers' Compensation Commissioner, the claimant (employee/decedent), and all parties to the claim of its intention to reduce or discontinue payment of the claimant's workers' compensation benefits.

Anyone wishing to file a claim for workers' compensation benefits with the Court must do so within two (2) years from the date of the injury or death, or within two (2) years from the date of payment of any compensation or wages in lieu of compensation, or within two (2) years of authorized medical care.

Workers compensation in Oklahoma is a “no-fault” system. You may qualify for workers comp benefits even if you were wholly or partially at fault for your injury or illness – as long as it arose from your employment. However, if you were intoxicated at the time of the incident, an employer can deny your claim.
