  2. Start by entering the file number related to the estate at the top of the form. This number allows for accurate identification of the case.
  3. Specify the state and county where the estate is being processed. This is important as it determines the jurisdiction of the court.
  4. In the section labeled 'IN THE MATTER OF THE ESTATE OF', insert the full name of the decedent. This identifies the individual whose estate is under administration.
  5. For the accounting period, indicate the start and end dates. This section defines the timeframe for the collection, disbursement, and distribution activities covered in the affidavit.
  6. Move to the 'PERSONAL PROPERTY RECEIVED' section. List the date property was received, who it was received from, a description of the property, and its value. Ensure that the total receipts amount is accurately calculated.
  7. Next, fill in the 'DISBURSEMENTS IN PAYMENT OF DEBTS AND EXPENSES' section. Here, you will document each payment made, including the date paid, to whom it was paid, the purpose of the payment, and the amount. Confirm that the total disbursements are correctly calculated.
  8. Record the balance remaining after disbursements in the designated section. This balance reflects the remaining personal property available for distribution.
  9. Under 'BALANCE DISTRIBUTED AS FOLLOWS', detail how the remaining balance will be allocated. Enter the amounts and ensure the total matches the balance amount.
  10. After reviewing all entries for accuracy, proceed to the signature section. Sign and date the affidavit, affirming that the information provided is complete and accurate. Include the signature of the notary or deputy clerk, if applicable.

Collection by Affidavit: The Process Once the court has approved the application, it will authorize the affiant to collect and administer the estate. The affiant must pay debts, and distributions must occur ing to the will (or the intestate succession law, if the decedent dies without a will).

A Minnesota small estate affidavit is used to collect property from the estate of a deceased person, known as the decedent.

An affidavit for collection is a procedure that transfers assets of estates that would otherwise be probated and that have a net value of under $75,000. With the affidavit, there is no court appearance, no personal representative appointed, and no mailed notification to interested parties.

Code §§ 13100-13116, the person(s) entitled to the property may present a Small Estate Affidavit, commonly known as an Affidavit for Collection of Personal Property, to the person or institution having custody of the property, requesting that the property be delivered or transferred to the successor.

The value of the probate estate, determined as of the date of death, wherever located, involving any contents of a safe deposit box, less liens and encumbrances, does not exceed $75,000.

Affidavit of No-Probate (PS2071) is used by one or more heirs at law (adult children, parents, siblings), who affirm they have the authority to represent all heirs and that the estate is not subject to probate. The applicant's signature must be notarized or witnessed.

Small estate affidavits are filed with the Register of Wills. They're used to simplify the probate process for estates valued at $50,000 or less. You can view other common probate forms provided by the State of Pennsylvania and the Register of Wills.
