The Dower Act protects a spouse if the couple's home is owned by the other spouse. It applies to a “homestead” which is a parcel of land where the owner lives or has lived. The Dower Act became law in Alberta over one hundred years ago.

The Alberta Dower Act is a form of homestead legislation. Specific Rules in the Alberta Dower Act. The main provisions in the Alberta Dower Act include the requirement of spousal consent to sell or burden the homestead, and that the life estate in the homestead is granted to the surviving spouse.

The Dower Act gives the surviving married spouse a life interest in that homestead. A dower life interest allows the surviving spouse to live in or rent the property but not sell it. The surviving spouse is responsible for the property's maintenance and capital costs while they hold the dower life interest.

Dower rights occur only in marriage – not in common-law or “Adult Interdependent Partner” relationships. Dower rights terminate upon divorce or if the party holding the interest provides a Release of Dower that can be registered on title to the property in question.

Upon sale, the Spouse releases Dower by signing the deed. If the spouse does not sign the deed, Dower will prevent the buyer from selling or refinancing the property in the future. This dower release deed can not be to their own spouse. It MUST be to the buyer to release Dower.

What Are Dower Rights. Today, dower rights protect the spouse of a registered owner of real property (a house on land). The Dower Act requires the spouse who is not on title to consent to any disposition of land. A disposition of land usually comes up as the sale or mortgaging of the property.

The release of dower rights and supporting affidavit must be executed and sworn by the spouse apart from the married person in whose favour the release is made.
