Pesticides must be registered with the DEC before they can be sold, distributed, or used in the state. Pesticide applicators must be certified before they can apply pesticides commercially. Businesses must be registered with the DEC before they can apply pesticides or offer services in New York State.

The notification requirements of CGS § 22a-66a, as they apply to the site in question and other sites, depend on who applies the pesticide, the type of site, and whether the pesticide is a restricted use pesticide (Roundup™ is not).

In ance with the 1990 Farm Bill, all private applicators are required by law to keep record(s) of their federally restricted use pesticide (RUP) applications for a period of 2 years.

Corporate agriculture and the pesticide industry loudly cautioned about the negative ramifications to agriculture after DDT, aldrin, and carbofuran were banned. But public health ultimately benefited by the removal of these dangerous pesticides and agricultural productivity has continued to steadily climb ever since.

There are approximately one million pesticide applicators in the United States certified to use RUPs and an estimate of 930,000 noncertified applicators.

Any private applicator wishing to buy and use Restricted-Use Pesticides (RUP) must be certified by passing the "Core" exam. Any private applicator wishing to buy and use "RUP" fumigants must also pass the Category 7d (Fumigation) exam.

1. When staffed, during normal business hours, each pesticide applicator business shall have someone authorized and available to provide the records required to be kept above immediately upon request by the Department and medical personnel in emergency situations.

The Pesticide Program conducts the examination, licensing, and certification of pesticide applicators.
